1. **ACCEPTANCE OF TERMS**
By participating in the Market Dwellings Loyalty Reward Program (the "Program"), you agree to these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not participate in the Program.
2. **ELIGIBILITY**
The Program is open to individuals who are legal residents of the United States and are at least 18 years old. Participation in the Program is void where prohibited.
3. **ENROLLMENT**
You can enroll in the Program by creating an account on our website or through our mobile application. When you enroll, you agree to provide accurate, current, and complete information about yourself. You may only have one Program account.
4. **EARNING POINTS**
Points are earned when you purchase qualifying products and services from Market Dwellings, as described on our website and in our communications to you. You may also earn points by completing certain tasks, as described in our communications to you. Points are not earned for taxes, shipping and handling charges, or other fees or services.
5. **REDEMPTION OF POINTS**
You may redeem points for discounts on purchases or for gifts, as described on our website and in our communications to you. The value of points when redeemed may vary. We may establish minimum point balances for redemption, maximum redemptions per period, and expiration dates for points.
6. **MODIFICATION AND TERMINATION**
We may modify these Terms or the Program at any time, in our sole discretion. If we make changes, we will notify you by revising the "Last Updated" date at the top of these Terms and, in some cases, we may provide you with additional notice. Your continued participation in the Program following a change to these Terms or the Program indicates your acceptance of the changes.
We may terminate the Program, or your participation in it, at any time, for any reason, in our sole discretion.
7. **LIMITATION OF LIABILITY**
In no event will Market Dwellings, its affiliates, or their respective directors, officers, employees, or agents be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including, but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses, arising out of or in connection with the Program.
8. **INDEMNITY**
You agree to indemnify, defend, and hold harmless Market Dwellings, its affiliates, and their respective directors, officers, employees, and agents from any and all claims and damages (including attorneys' fees) arising out of your breach or alleged breach of these Terms.
9. **GOVERNING LAW**
These Terms are governed by the laws of the state of California, without reference to its conflict of laws principles.
